The Short Version
Treat me fairly, I'll treat you fairly. Pay on time, get great work. Communicate clearly, get exactly what you want. Try to screw me over, and these terms kick in. Most projects never need lawyers - just good people doing good work.
1. Website Usage Terms
Who Can Use This Site
This website is for potential clients, current clients, and anyone curious about quality web development in El Paso. If you're under 18, get a parent's permission before contacting me about projects.
Acceptable Use
Feel free to:
- Browse the site and learn about my services
- Contact me about legitimate projects
- Share links to pages that might help others
- View my portfolio and case studies
Please don't:
- Try to hack, break, or overload the website
- Copy my content without permission
- Use the contact form for spam or abuse
- Impersonate me or my business
2. Web Development Services
Project Process
- Discovery: We discuss your needs, goals, and budget
- Proposal: I send a detailed proposal with scope, timeline, and pricing
- Contract: If you accept, we sign a project-specific contract
- Deposit: 50% down payment to start work
- Development: I build your website with regular updates
- Review: You review and request revisions (within scope)
- Launch: Final payment, then we launch your site
What's Included
Standard web development projects include:
- Custom website design and development
- Mobile-responsive layout
- Basic SEO optimization
- Performance optimization
- 2 rounds of revisions
- Basic training on content updates
- 30 days of post-launch support
What's Not Included
Unless specifically mentioned in your proposal:
- Ongoing content creation or copywriting
- Stock photos or premium images
- Third-party integrations (payment processors, etc.)
- Ongoing maintenance beyond 30 days
- Social media setup or management
- Email marketing setup
- Hosting setup (though I can recommend providers)
3. Payment Terms
Pricing and Payment
- Deposit: 50% required to start any project
- Final Payment: Due before website launch
- Payment Methods: Bank transfer, Zelle, or check
- Late Fees: 2% per month on overdue balances
Refund Policy
Before work starts: Full refund of deposit, no questions asked.
During development: Partial refund based on work completed. You keep all work done up to that point.
After completion: No refunds, but I'll fix any bugs or issues during the 30-day support period.
4. Intellectual Property
Your Content
You own your content (text, images, logos, etc.). By providing it to me, you give me permission to use it for your website project.
My Work
Code and design: You own the final website code and custom designs after full payment.
Reusable components: I retain rights to general code patterns, frameworks, and tools I've developed.
Portfolio rights: I can showcase your project in my portfolio and case studies (unless you specifically request otherwise).
5. Project Timeline and Changes
Timeline Estimates
Project timelines are estimates based on the agreed scope. Delays can happen due to:
- Client feedback and revision cycles
- Missing or delayed content from client
- Scope changes or additions
- Technical complications
- Acts of God (or Internet outages)
Scope Changes
Want to add features mid-project? No problem, but:
- Changes may affect timeline and cost
- I'll provide a written estimate before proceeding
- Significant changes may require a new contract
- Minor tweaks are usually included
6. Client Responsibilities
To keep projects on track, I need you to:
- Provide content: Text, images, and other materials in a timely manner
- Give feedback: Clear, specific feedback within 7 days of each review
- Make payments: On time, as agreed
- Communicate: Respond to emails and calls reasonably quickly
- Test your site: Review everything before launch
7. Warranties and Limitations
What I Guarantee
- Your website will work as specified in the proposal
- Code will be professional quality and well-documented
- Site will be mobile-responsive and performant
- I'll fix any bugs during the 30-day support period
What I Don't Guarantee
- Your website will make you rich (that's on you)
- 100% uptime (hosting depends on your provider)
- Compatibility with every browser from 1995
- Protection against future changes to third-party services
Limitation of Liability
If something goes wrong, my total liability is limited to the amount you paid for the project. I'm not responsible for lost profits, business interruption, or consequential damages.
Translation: I'll fix problems and make things right, but I can't be responsible for your entire business success or failure.
8. Termination
You Can Cancel If:
- I materially breach the contract and don't fix it within 30 days
- I become unable to complete the work
- You just decide you don't want the website anymore
I Can Cancel If:
- You don't make payments as agreed
- You're abusive or unreasonable
- You ask me to do something illegal or unethical
- The project scope becomes impossible or undefined
Upon Termination
You get all work completed up to that point. Any remaining payments are calculated based on work done. We part ways professionally.
9. Dispute Resolution

Most problems can be solved with a phone call. If there's an issue, let me know and I'll do my best to make it right.
Legal Stuff
These terms are governed by Texas law. Any disputes will be handled in El Paso County courts. But seriously, let's just talk it out first.
10. Miscellaneous
Updates to These Terms
I may update these terms occasionally. Current clients are governed by the terms in effect when they signed their contract. New projects use the current terms.
